1. Nature of the Application

Heda (hereinafter "the Application") is developed and provided by EXSports Oy strictly as a personal diary and wellness tool. It allows users to log migraine episodes, symptoms, triggers, and related health data for their own personal reference. It integrates with Google Health Connect to read health data (such as sleep sessions and stages, heart rate, heart rate variability, step counts, and exercise sessions) from your device, subject to your permissions. Heda never writes data back to Health Connect.

The Application is provided "as is" without warranties of any kind, either express or implied, regarding its accuracy, reliability, or suitability for any specific purpose.

2. Not a Medical Device

You expressly acknowledge and agree that Heda:

• Is not a medical device and has not been reviewed or approved by any medical regulatory authority
• Is not intended to diagnose, monitor, treat, or prevent any disease or medical condition
• Is not a substitute for professional medical advice, diagnosis, or treatment
• May contain errors, inaccuracies, or technical faults in data recording or display
• Should not be used as the sole or primary source of information for any health-related decision

Always seek the advice of a physician, neurologist, or other qualified health provider with any questions you may have regarding your condition. Never disregard professional medical advice or delay seeking it because of information recorded or displayed in this Application.

3. No Warranty and Limitation of Liability

EXSports Oy makes no representations that the Application is error-free, accurate, or suitable for any specific purpose. Diary entries, data records, and any statistics or summaries generated by the app may contain errors, rounding differences, or inaccuracies.

To the fullest extent permitted by applicable law, EXSports Oy shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:

• The use of or inability to use the Application
• Errors, inaccuracies, or omissions in diary records or generated summaries
• Any health-related decision made in reliance on the Application's output
• Loss of diary data due to device failure, app uninstallation, or other causes
• Loss of data, revenue, business opportunity, or reputation

3A. Statutory Consumer Rights

Nothing in this Agreement excludes or limits EXSports Oy's liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Intentional or grossly negligent acts by EXSports Oy, its employees, or agents
• Any other liability that cannot be excluded or limited under Finnish law or applicable EU law

4. Google Health Connect

The Application may integrate with Google Health Connect to read health data (such as sleep sessions and stages, heart rate, heart rate variability, step counts, and exercise sessions) from your device. Heda does not write any data back to Health Connect. This integration is available to premium users only. EXSports Oy is not responsible for the accuracy, availability, or integrity of data retrieved from Health Connect. The use of Health Connect is subject to Google's own terms of service and privacy policy.

You can revoke Health Connect permissions at any time in your device's Android settings. Revoking permissions will disable the Health Connect integration but will not affect diary data stored locally within Heda.

5. User Responsibilities

By using this Application, you agree to:

• Use the Application solely for personal diary and wellness tracking purposes
• Not rely on the Application for any medical, clinical, or professional health decisions
• Consult qualified healthcare professionals for any health concerns
• Comply with all applicable laws and regulations in your jurisdiction
• Not attempt to reverse engineer, decompile, or extract source code from the Application
• Maintain regular device backups to avoid loss of diary data

6. Software Updates and Changes

EXSports Oy reserves the right to modify, update, or discontinue any features of the Application at any time without prior notice. EXSports Oy is not liable for any differences in data display or behaviour between versions of the Application.

7. Indemnification

You agree to indemnify, defend, and hold harmless EXSports Oy, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your violation of these Terms of Use
• Any third-party claims resulting from your use of the Application contrary to these Terms
• Your breach of any representation or warranty made in this Agreement

This indemnification does not apply to claims arising from EXSports Oy's own negligence or breaches of its obligations under applicable law.

8. Governing Law and Dispute Resolution

This disclaimer is governed by the laws of Finland, without regard to its conflict of law provisions.

For consumer users in Finland or the EU: You retain the right to bring legal proceedings in the courts of your country of residence, as provided by EU Regulation 1215/2012 (Brussels Ia).

For business users: Any disputes shall be subject to the exclusive jurisdiction of the Finnish courts, with the District Court of Kymenlaakso as the court of first instance.

9. Severability

If any provision of this Agreement is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be made enforceable, it shall be severed. The remaining provisions shall continue in full force and effect.

10. Changes to This Disclaimer

EXSports Oy may update this disclaimer at any time. The effective date at the top of this page will reflect the date of the most recent revision. Continued use of the Application following any changes constitutes acceptance of the revised disclaimer.

11. Entire Agreement

This Disclaimer & Terms of Use, together with the Privacy Policy, constitutes the entire agreement between you and EXSports Oy regarding the use of this Application.
