SurveyTools (hereinafter "the Application") is developed and provided by EXSports Oy strictly as a recreational and educational aid. It is not a certified instrument, nor is it intended for professional, commercial, or safety-critical applications.
The Application is provided "as is" without warranties of any kind, either express or implied, regarding its accuracy, reliability, or suitability for any specific purpose.

Using this Application for professional purposes is done entirely at your own risk and is expressly prohibited under these Terms.

To the fullest extent permitted by applicable law, EXSports Oy shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:

This indemnification does not apply to claims arising from EXSports Oy's own negligence, defects in the Application's design, or breaches of EXSports Oy's obligations under this Agreement or applicable law.
The Application includes offline functionality that allows continued use for up to 90 days without an active internet connection. During this period, the Application operates based on the last verified subscription status. EXSports Oy is not liable for any interruption of service that occurs when the offline grace period expires or when a subscription lapses.
It is the user's responsibility to maintain an active subscription and to periodically connect to the internet to verify subscription status.
EXSports Oy reserves the right to modify, update, or discontinue any features of the Application at any time without prior notice. Calculation methods, formulas, or results may be updated in future versions. EXSports Oy is not liable for any differences in results between versions of the Application.
Users are encouraged to keep the Application updated to the latest version to benefit from improvements and bug fixes. However, updates are provided on an "as available" basis without warranty.
Some calculations in the Application may be based on industry standards, published tables, or reference data (such as API standards, ASTM tables, or ISO specifications). EXSports Oy endeavours to implement these correctly, but does not represent or warrant that its implementation is certified, audited, or endorsed by any standards body or regulatory authority.
Users should refer to the original published standards and consult with qualified professionals for authoritative reference and interpretation. The Application's implementation of such standards is for educational purposes only.

This disclaimer is governed by the laws of Finland, without regard to its conflict of law provisions.
For consumer users in Finland or the EU: You retain the right to bring legal proceedings in the courts of your country of residence. Any disputes arising from the use of the Application may be subject to the jurisdiction of Finnish courts or the courts of your habitual residence, as provided by EU Regulation 1215/2012 (Brussels Ia).
For business users: Any disputes shall be subject to the exclusive jurisdiction of the Finnish courts, with the District Court of Kymenlaakso as the court of first instance.
If any provision of this Agreement is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be made enforceable, it shall be severed from this Agreement. The remaining provisions shall continue in full force and effect.
EXSports Oy may update this disclaimer at any time. The effective date at the top of this page will reflect the date of the most recent revision. Material changes will be communicated through the Application or via email if you have provided contact information.
Continued use of the Application following any changes constitutes acceptance of the revised disclaimer. If you do not agree to the updated terms, you must discontinue use of the Application.
This Disclaimer & Terms of Use, together with the Privacy Policy, constitutes the entire agreement between you and EXSports Oy regarding the use of this Application and supersedes any prior agreements or understandings.
